Frequently Asked Questions
Re the Troubleshooting, what sort of issues do you resolve?
Anything relating to Land Registration Law and Practice whether it relates to tricky register entries, restrictions, leases, plan queries, execution, deeds of variation, upgrades, capacity, adverse possession, merger, prescriptive rights and so on.
Examples of previous referrals can be found below :-
- Clients attempting to acquire additional garden land by way of adverse possession as part of the purchase. Referral asking to review content of the ST1 (defective) and to advise what would be required to satisfy requirements for a possessory title in their situation
- Sale proceeding with two Receivers appointed by the prime lender. Two restrictions on title including the Form A and three current pending applications that had priority. Referral made pre-completion asking for advice re how to deal with each restriction correctly and the impact of the 3 pending applications
- Title plan received back from LR but a corner of the purchase property actually fell outside the title plan extent and protruded onto adjoining land not owned by the client. Referral asked for information how this had happened and how to resolve
- Deed of Variation had been drawn to reflect an alteration to the extent of a Lease to include the loft space. Deed had been rejected by LR for multiple reasons. Referral requested advice on how to resolve each issue
- TR1 rejected by LR on three separate occasions. Form A restriction on the register, title had devolved to a sole owner following the death of a joint proprietor, Probate had been received but the execution of the TR1 was incorrect each time. Referral asking for advice on correct execution
- Four people selling and purchasing side received an ST4 by one seller only re the acquisition of a prescriptive right. Referral made to advise if ST4 was satisfactory (defective) and what the requirements would be for the easement to be acquired
- Property purchase also included a garage that seller had no title to. Referral re how it might be possible to acquire garage title by way of adverse possession and also acquire a prescriptive right over the access that led from the property to the garage
- Purchaser buying a good leasehold title wanting to upgrade to absolute and also looking to acquire the freehold. Title was an underlease, the freehold title was registered but headlease was not. Referral for advice on both points
What does the Troubleshooting service cost?
We will agree a flat rate fee in advance for each referral, usually reflective on the volume of referrals you anticipate sending through (i.e. if you think it’s a service you will use a lot, the rate can be reduced)
Is the fee different if the referral is highly complex?
No, irrespective of complexity, the fee will be the same each time
Is there any obligation on our part to send a certain number of referrals to you?
No, you only need refer issues as and when you need to
How does the training work?
We have a list of modules we can deliver over Teams/Zoom or in person at your premises
Can the modules be combined/altered?
Yes. We can tailor a session to cover the specific topics you request
